Terms of service.

Welcome to In House Service. These Terms of Service ("Agreement") govern your access and use of our website and services, including services performed by our employees in the field. By purchasing services through our website or engaging our team, you agree to be bound by these terms. Please read them carefully.

1. Service Performance & Warranty

Service Provider will perform all services in a workmanlike manner consistent with standard industry practices.

EXCEPT AS OTHERWISE STATED, SERVICES ARE PROVIDED “AS IS,” AND SERVICE PROVIDER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

2. Limitation of Liability & Disclaimer of Damages

a. Limitation of Liability: In House Service and its affiliates, contractors, subcontractors, and agents (collectively, “In-House Parties”) shall not be liable for any claim arising out of or related to this Agreement in an amount exceeding, in aggregate, the fees actually paid by the Homeowner to Service Provider for the specific service giving rise to the claim within the three (3) months immediately preceding the filing of such claim.

b. Exclusion of Damages: In no event shall In-House Parties be liable for consequential, indirect, special, incidental, punitive, or exemplary damages, including but not limited to lost revenue, profits, business opportunities, goodwill, or other economic loss arising out of or related to this Agreement.

c. Scope of Limitation: These limitations apply:

  • To claims based on negligence;

  • Regardless of the form of action (contract, tort, strict liability, or otherwise);

  • Even if Service Provider has been advised of the possibility of damages;

  • To claims for attorneys’ fees and litigation costs;

  • Even if any remedy provided under this Agreement fails its essential purpose.

d. Applicability of Law: If applicable law limits the enforcement of this section, the liability of In-House Parties shall be limited to the maximum extent permitted under such law.

3. Payment & Credit Card Authorization

The Homeowner authorizes Service Provider to charge the credit card on file for payment of fees related to selected service plans, additional services, or on-demand services under this Agreement. Charges will be processed per the specified service plan or invoice terms.

The Homeowner agrees to provide and maintain valid payment information. If a charge is declined, an alternative payment method must be provided within five (5) business days to avoid service interruptions. The Homeowner may revoke this authorization in writing, subject to settling any outstanding balances.

4. Compliance with Illinois Home Repair and Remodeling Act

This Agreement complies with the Illinois Home Repair and Remodeling Act (815 ILCS 513/). The Homeowner acknowledges receipt of the “Home Repair: Know Your Consumer Rights” pamphlet prior to execution of this Agreement. If the total cost of services exceeds $1,000, a written work order detailing the scope, services, and materials will be provided before commencing work. Any changes must be documented in a written and signed change order.

5. Hazardous Materials Disclaimer

Service Provider shall not be responsible for identifying, detecting, abating, encapsulating, storing, removing, or transporting any regulated or hazardous substances, including but not limited to asbestos, refrigerants, or refrigerant oils. If such materials are encountered, Service Provider may discontinue work until they are removed or liability is mitigated.

6. Delays & Equipment Availability

Service Provider does not guarantee completion dates and shall not be liable for delays due to equipment availability, supply chain issues, or other factors beyond its control. Monetary compensation is not available for inconvenience or lost revenue resulting from delays.

7. Entire Agreement & Modifications

This Agreement constitutes the entire agreement between Service Provider and Homeowner, superseding all prior understandings. Modifications must be in writing and signed by both parties.

8. Governing Law

This Agreement shall be governed by the laws of the State of Illinois. If any provision is deemed invalid, the remaining terms shall remain in effect.

9. Electronic Signatures

This Agreement may be executed electronically, and electronic signatures shall have the same legal force as handwritten signatures. Both parties waive any defense asserting electronic signatures are invalid.4
